The deadline to obtain loans or LDPs for 2011 crop corn, dry peas, grain sorghum, lentils, mustard seed, safflower seed, chickpeas, soybeans and sunflower seed is May 31, 2012. The deadlines for all other eligible commodities for 2011 crops have already passed. Marketing assistance loans provide producers interim financing at harvest time to meet cash flow needs without having to sell their commodities when market prices are typically at harvest-time lows.
The final date to enroll in DCP or ACRE is June 1, 2012. All producers who share in base acres and have a risk in the production of crops on the farm must sign the DCP or ACRE contract by this date. Changes to the farming operation after enrolling, including producers sharing in the crop, must be reported to your local FSA office.
Participants with a 2011 Average Crop Revenue Election (ACRE) contract must report their actual production of ACRE commodities to FSA by July 15, 2012, to remain in compliance with the terms and provisions of the contract. Failure to report production can require a refund of benefits, including direct payments, issued under the contract. Contact your local FSA office for additional information.

Don’t miss the upcoming 2012 acreage reporting deadlines. Small grains, including wheat, oats and rye, must be reported by June 30. All other crops, including Conservation Reserve Program (CRP) acres, must be reported by July 15, 2012. Acreage reports are required to maintain eligibility for most program benefits and important to establish cropping history for future programs.
Producers participating in DCP or ACRE are prohibited from planting FAV’s on base acres, unless a producer or farm FAV history exists. Producer history must be for the specific FAV being planted. Exceptions exist for FAV’s planted and reported for certain intended uses. Planting restricted FAV’s may be considered a violation of the DCP/ACRE contract. The Land Contract (LC) Guarantee Program is a new FSA loan program that will provide a government backed guarantee to landowners who sell their farm real estate to a beginning or socially disadvantaged farmer/rancher through a private land contract. Under this program there are two options, one that guarantees up to three annual installment payments on the contract and another that guarantees 90% of the unpaid principal balance of the contract. Only new land contracts are eligible for this program and the purchase price must not exceed $500,000. Contracts must be amortized over a minimum of 20 years and the buyer must provide a down payment of 5% of the purchase price. The guarantee period is for 10 years.
All 2009, 2010 and 2011 program participants who received benefits subject to Adjusted Gross Income (AGI) limitations are required to provide written consent to the Internal Revenue Service (IRS) for the disclosure of certain information to FSA. Program participants who have not filed the required consent need to submit form CCC-931 immediately to avoid a request for refund of applicable FSA and NRCS program payments.
Conservation compliance is critical to maintaining eligibility for USDA program benefits. Areas identified as wetlands cannot be drained or manipulated. Contact your local FSA or NRCS before breaking new ground or taking any action that would potentially affect a wetland, including removal of trees. An acceptable conservation system must be applied on all highly-erodible land.
